Glad you were able to walk away in one piece.

I can see where you are coming from (sounds like a bad pun)
A police report or (preferably) getting him prosecuted for the offence would give you some clout when dealing with his insurance company - and yours too if they decide to do a deal that suits them and not you, or if he decides to claim for you running into his parked car. Unfortunately nobody gives a shit and you are on your own.

The truth is, it's one person's word against another, and no court in the land will prosecute in a situation like that.
Something similar happened to me when I was about 20.

Me proceeding up a left hand lane when a passenger car door opened in the right hand lane.
Hit the door and got floored - thankfully not going fast. Managed to keep the bike upright and just about get off, but ankle was in agony.
Ambulance was called, (for which I got the bill). Guess who got charged - got it in one! ME!

Driving without due care and attention and driving with disregard to other road users. Unbelievable!

It never went to court, but both the the driver and passenger did and were eventually found guilty of the same offences and got points and were fined heavily, but I should never in a million years have been subjected to that. It was only becasue I was a bike and the shitbags told the police, (who I didn't even know were involved until a young wippersnapper arrived at my house a few days later to caution me - which I though was a bit over the top!), that I slipped up the inside, which wasn't true.

And another "guess what"....This is what we all call "filtering" now, which, for obvious reasons I never do anymore.

Carol Nash took my scoot away this evening for a damage report, so I don't even have that now either, still best in a way as its raining and may be set in for some time
